OtterBox to pay $4.3M to settle allegations

DENVER BUSINESS JOURNAL - Fort Collins-based OtterBox, a maker of protective cases for smartphones and tablets, has paid $4.3 million to the United States to resolve allegations that the company knowingly underpaid customs duties from 2006 to 2011.

The U.S. Attorney's Office for Colorado, the Department of Homeland Security and U.S. Customs and Border Protection said Monday that between 2006 and 2011, OtterBox manufactured many of its products overseas and imported those products into the United States for distribution and retail sale.

The U.S. government alleges that between Jan. 1, 2006 and Dec. 31, 2011, OtterBox "knowingly omitted the value of 'assists' [something of value provided by an importer to a foreign producer] from the dutiable value OtterBox declared to customs on entry documents for imported products."

Further, the government alleges that OtterBox "knowingly made or caused to be made false statements in other documents submitted to customs concerning the value of assists."

According to the allegations from government regulators, "as a result of OtterBox's omissions and false statements concerning the value of assists for its imported products, OtterBox knowingly underpaid customs duties it owed to the United States."
