Immigration officials say it appears that 23-year-old Francis Maudaniel Hernandez was born outside the country. ICE spokesman Carl Rusnok says the detainer means that Hernandez will be released to immigration authorities if the state releases him.

Hernandez is accused of running a red light in his SUV and hitting a pickup, which was sent hurtling into an Aurora ice cream store. The two women in the pickup were killed instantly and a boy in the store died later of his injuries.

Authorities say Hernandez, arrested after fleeing the scene, has an extensive criminal record.
