The incident happened on Jan. 24 in a mobile home park. Police say Matt Herrera, 30, had fled from police just before 7 a.m. Police then waited for him to return to his fiancée's home.
When he returned around 7 a.m., they confronted him. Police say Herrera drove towards Officer Jim Torrez. Torrez fired around a dozen shots into the car, according to police. Herrera was pronounced dead at the hospital.
The surveillance video shows Torrez pulling up in the squad car. It then shows Herrera's car bumping into the police car. Torrez then moves into the upper left-hand portion of the screen. The car remains unseen throughout much of the video.
Herrera's fiancée, Crystal Eggleston, then comes out of the trailer and approaches Torrez. Torrez is seen pushing her into the snow.
It is unclear when Torrez fired into the car.
Eggleston says Herrera never provoked Torrez.
"The police lied about everything. What they did is wrong and they know it," Eggleston said.
This week, the Weld County District Attorney asked a grand jury to review the police report and decide whether to move the case to trial.
Eggleston says she was subpoenaed to testify in front of the grand jury Thursday.
Torrez is on paid administrative leave pending the results of this investigation.
