Denver deputy charged after slapping inmate

DENVER - A Denver Sheriff's deputy is on investigatory leave after allegedly slapping a woman who was being processed into the jail on suspicion of DUI.

Anne Kelly is charged with third-degree assault and harassment in connection with the incident that happened on March 25.

According to investigators, Kelly claims the DUI suspect was not being cooperative while being processed and booked into the Denver County Jail. That is when police say Kelly slapped the woman.

The Denver Sheriff's Department does have video of the incident but is not making the video public at this time.

"It was one slap," Denver District Attorney's office spokesperson Lynn Kimbrough said.

She says the deputy faces misdemeanor charges because the inmate wasn't seriously injured.

Kelly was first put on an administrative duty assignment following the incident. Once she was charged, the sheriff's department put her on investigatory leave.

In a statement released Wednesday, Denver Undersheriff Gary Wilson said, "In matters like this, where there is an ongoing criminal investigation, the administrative investigation into policy violations is suspended until the criminal matter is resolved."

The release went on to say the internal investigation will continue following the criminal case.
