Man admits to mistake after 3-year-old shot 5-year-old

"I mean it was totally my fault," police say Adam Laham, 23, told detectives. "I'm not used to having kids in the house, you know. I always leave it out."

Lakewood Police arrested Laham on Dec. 23 after Rolyn Victor Paco Lee Javier, 5, was shot at the Eagle Crest Apartments on Iris Street in Lakewood. Rolyn was taken to Saint Anthony's West Hospital where he later died.

Court documents reviewed by 9Wants to Know show Laham was a family friend from Kansas. He and another woman were staying at the home where Rolyn lived and sleeping in his room.

Police say Laham told a detective he gave permission for Rolyn to go into the room and play video games.

"Adam stated that when he told the kids it was OK to go in and play in their room. He didn't realize the firearm was there," the affidavit says he told a detective.

A detective also says Laham told him he had left the gun on a container in the room where he stayed.

"He told me he always has it loaded. It's a Kel-Tech .32. It holds six or seven rounds plus one, and he always keeps a round in the chamber. He stated it does not have a safety," a detective wrote in the affidavit.

Police also interviewed Rolyn's 3-year-old brother who they say admitted to picking up the gun and accidently "shooted" Rolyn.

9NEWS is not naming the 3-year-old because he is a minor.

Laham faces charges of child abuse resulting in death and criminal negligence.

A judge set Laham's bond at $40,000 on Dec. 24. He is scheduled to be in court Dec. 30.
