The Grand Junction Daily Sentinel reports the state will pay Ivan "Gene" Lawyer $41,903.
The back payments cover the period from October 2010, when he was indicted by a Mesa County grand jury, through May 3 of this year, when prosecutors moved to dismiss two charges that were deadlocked after April's jury trial.
Lawyer was acquitted of four other charges, including criminally negligent homicide. He and State Patrol Cpl. Kirk Firko were charged after they went to Jason Kemp's Redlands home July 20, 2010, while investigating a traffic accident.
Lawyer said that during a struggle, he shot Kemp because he saw him raise his arm and thought he had a weapon.
