Prosecutors say 19-year-old Daniel J. Richards was acting violently and was put in a choke hold at an April 10 house party. The Daily Sentinel reports Richards appeared to fall asleep and his friends took him to a hospital, where he died.

Mesa County District Attorney Pete Hautzinger said at a news conference Tuesday that charges would have been filed if Richards was put in a choke hold and "wasn't being violent or tweaked out on drugs." The prosecutor added that there was nothing reckless or negligent about trying to get the teen under control.
