Officer will not be charged for shooting sword-wielding attacker

Police say the suspect attacked an Auraria campus officer the morning of Nov. 10 with a sword. Reportedly, the suspect had a history of mental illness.

The 38-year-old Jeffrey Albert Musick had his last listed address as a psychiatric hospital in Arapahoe County. Based on 9NEWS research, Musick had been at two different psychiatric facilities in recent history.

Musick critically injured an officer on the Auraria campus. The officer's finger was almost severed, according DPD's Raquel Lopez. The officer was released from the hospital, but his name was not immediately released.

"This tragic incident brings focus to two recurrent issues in use of force events, both of which often lead to public mis-perceptions. The first is the rapidity with which the events may unfold. The second is the 'lethality' of edged weapons. Officer Burnett arrived at what he at first believed would be a situation where he would be called upon to warn someone about campus policy. Within moments, he was attacked by an adversary armed with a sword who was able to close the distance between them and injury him severely. Officer Burnett attempted to retreat and reason with Musick, without success. He then drew and fired his pistol. He stopped firing immediately when the threat ceased. The incident - from the time Officer Burnett advised dispatch he was contacting a party to the time shots were fired - took less time than it would take the average American reader to read this paragraph," the department concluded after investigating the fatal officer-involved shooting.

9NEWS has learned Musick had an extensive criminal history in the area, having been arrested by multiple jurisdictions including Denver and Arapahoe County sheriff's offices, and Jefferson County, Lakewood and Littleton Police. Obstructing police, drugs and weapons charges are listed in this Colorado criminal history.

9NEWS has reached out to all Musick's relatives but hasn't heard back.

Auraria Police were called to Ninth and Walnut streets near the Tivoli Student Center at 5:54 a.m. Lopez said someone called dispatch reporting a man with a sword. Police confronted armed, sword-swinging Musick in front of the Tivoli building. He was shot several times. The Coroner said he died of multiple gunshot wounds.
