DENVER (AP) - Colorado's Senate president has failed in first attempt to stop a recall election based on a technical error by his opponent.
But Democratic Sen. John Morse plans to appeal the decision Wednesday from the secretary of state's office. That means a legal battle will continue over whether Morse should be the first Colorado lawmaker ever to face a recall election.
Morse and another Democratic lawmaker are facing recall efforts because of their support for new gun control laws.
