Case to proceed against suspect in crash that killed girl

LONGMONT, COLO. (AP) - A judge has ruled there is enough evidence to move forward with the case against a man accused of driving under the influence of marijuana in a crash that killed an 8-year-old girl riding her bike in Longmont.

The Times-Call reports the case against Kyle Kenneth Couch was bounded over to district court Thursday. The 20-year-old man faces several charges related to the May 20 crash, including vehicular homicide and DUI.

Couch is accused of running over and killing Peyton in his pickup truck as she rode in a crosswalk alongside her stepfather.

Investigators say marijuana was in his system at the time of the collision.

But Couch's attorneys maintain prosecutors don't have enough evidence proving he was under the influence.

Couch will be arraigned on the charges in January.
