A waiter at Ruby Tuesday's in Colorado Springs says the woman 56-year-old Robert Psaty was eating with left the table, and that's when the waiter saw Psaty slip something into her drink.

"The woman gets up from the table and as soon as she does, the man reaches into his pocket and pulls out a pill and puts it in her drink he starts mashing it up with a straw and starts stirring it in," said Colt Haugen, the waiter at Ruby Tuesday's.

Haugen says he grabbed the drink and called police.

Colorado Springs Police tested the drink and said it contained valium, a tranquilizer used to relax muscles and relieve anxiety.

Psaty is a former member of the Florence City Council and is on administrative leave from his job at the state mental hospital. He is currently out on bail and is due back in court on Feb. 27.
