Steven Stagner filed a motion earlier this year for a hearing before a six-person jury to determine if he is well enough to be released from the Colorado Mental Health Institute at Pueblo.
Stagner is promising to seek further treatment and therapy outside the institution.
According to the Glenwood Springs Post Independent, the hearing on Stagner's motion is scheduled for Sept. 13.
The district attorney is opposing his release.
