On Friday, the court's listing of records in the case reveal prosecutors have responded to a defense motion accusing them of a "reckless disregard for the truth. "
The motion, which is sealed, is asking the court for sanctions against the prosecution.
The reason behind the allegation is unclear, but prosecutors have made statements in court that James Holmes may have been motivated after failing a college exam and that he was banned from the University of Colorado campus for making threats.
A University of Colorado spokesperson has said Holmes was never banned from the campus, but that his keycard for building access was deactivated after he withdrew from his studies in June.
The court's registry of action shows prosecutors have made copies of evidence in the case and sent a packet of paperwork, including a sealed envelope to Chief Judge William Sylvester in response to the defense's motion.
