The Weld County District Attorney charged Jordan Limas, 18, with one count of criminally negligent homicide, a class 5 felony, in the death of his brother, Andre Limas.
According to the arrest affidavit, Jordan left the gun on the dining room table. As he was leaving his bedroom authorities say he saw Andre playing with it and told his brother the gun was not a toy, to which Andre responded "Ya right."
Jordan told police there he struggled with his brother while trying to take the gun away from him. The gun went off while it was in Jordan's hand, according to the affidavit.
Limas has posted a $30,000 bond in the case.
He is scheduled to appear in Weld County District Court for an advisement hearing on Oct. 25.
