Aurora theater shooting suspect James Holmes' CU documents to be released to prosecution

The order grants the prosecution access to some University of Colorado educational records of suspect James Holmes. Holmes was working towards a Ph.D. in neurosciences but suddenly quit in June, a few weeks before the shootings.

The order reveals the prosecution's plan to use the university documents to show what happened with Holmes before the shooting.

"The People state that Defendant's career path at the university will illustrate his general dissatisfaction with life and a downward spiral, which resulted in the events of July 20, 2012," the judge's order says.

Prosecutors will get access to: 

  • Holmes' university application 
  • Unofficial transcripts 
  • Withdraw documents and other documents from the Neurosciences department 
  • Some university police records. 
But other significant documents from CU will not be disclosed because the judge felt the prosecution could not establish relevance of the documents in the case or the documents are privileged because of a doctor-patient relationship. 

What the prosecution will not get: 

  • Class schedule 
  • Database notes containing "communications" that may be privileged under a doctor-patient relationship 
  • Any information Holmes' psychiatrist Dr. Lynne Fenton gave to university police. 
  • Voicemail from the University of Colorado
