The judge says they will still meet on Oct. 25, but will simply discuss the preliminary hearing and other types of scheduling matters - not the evidence in the case.
The defense team for the man charged with killing 12 people in the Aurora movie theater shooting on July 20 said on Oct. 11 that they would not be ready for the Nov. 13 hearing - as they have at least 18,000 pages of documents to sift through and expect thousands more to come forward. The attorneys also raised the point that they want to reconvene after the holiday season - possibly in January.
The prosecution responded to the defense's motion, saying they want to still meet on Oct. 25 in order to "address on the record the formal continuance of the proof evident/presumption great preliminary hearing."
The hearing could be delayed to January or February 2013.
