Judge Mark Moran in Arizona says he'll do so on Nov. 20 after reviewing evidence in Scott Curley's case.
Curley faces up to life in prison for the 2010 shooting death of Kane County Deputy Brian Harris along the Arizona-Utah border. He's also pleaded guilty to aggravated assault, theft and burglary charges.
Harris' mother pleaded with Moran to not give Curley an opportunity to kill again. Curley's family asked Moran to find a way for him to get mental health services.
Earlier Friday, attorneys sparred over whether Curley's actions were those of a man who knew exactly what he was doing or the result of delusional beliefs.
