DENVER - The Denver District Attorney's Office filed a motion Friday to dismiss charges against an 85-year-old man in a parking lot assault case in December.
John Copeland was charged with 3rd degree assault. The DA dismissed the charges because of Copeland's failing health.
The charge stems from an incident in the Stapleton Home Depot parking lot. Copland is accused of using a cane to assault a 66-year-old parking enforcement volunteer.
Copeland was sitting in his parked car in a handicapped spot when the volunteer confiscated Copeland's handicapped placard because he said it was expired.
Copeland says he didn't understand who the man was and confronted him.
Copeland spent four days in jail.
