KUSA - Defense attorneys for theater shooting suspect James Holmes will be in court Friday to try to block the use of his personal and school emails as evidence.
Holmes' defense says the records obtained from his Google and Microsoft emails were from an illegal search and seizure.
They say that authorities did not have the correct email address when a search warrant was executed, asking for access to email@example.com instead of firstname.lastname@example.org.
While prosecutors acknowledge the email was incorrectly written in the search warrants, it was correct in other documents, including the affidavit.
Prosecutors also maintain they had probable cause to obtain access to Holmes' email accounts.
