CENTENNIAL - 9NEWS legal analyst Scott Robinson has concluded a psychiatrist at the state mental hospital found the Aurora theater shooting suspect insane after his first mental evaluation.

Robinson's conclusion is based on the latest court order that will require James Holmes to undergo another sanity evaluation.

The order was published Wednesday afternoon on the 18th Judicial District's Website.

The order is a brief win for the prosecutors who asked for another sanity evaluation after James Holmes was interviewed and observed at the state's mental health hospital in Pueblo last fall.

"The people have demonstrated that the CMHIP examination is incomplete and inadequate," the judge's order says.

The order requires the state to select another psychiatrist by March 10.

9NEWS talked with the family of one of the victims. They have mixed emotions about the judge's order. They're hopeful that the insanity plea will be dropped, but they don't want the process to be extended in any way.

If jurors eventually decide Holmes was insane, he would be acquitted of the crimes and committed indefinitely to the state hospital. If they decide he was sane, he could be convicted and sentenced either to be executed or spend life in prison without parole.

Holmes is charged with killing 12 people and injuring 70 in a 2012 attack on an Aurora movie theater. He has pleaded not guilty by reason of insanity.
