WESTMINSTER - The Adams County District Attorney's Office said Monday no charges will be filed against a security guard who shot and killed a man outside an apartment complex in Westminster earlier this month.

Gustav Ruppel was working security at the Sunset Ridge Apartments early on the morning of August 2. He shot and killed David Ludewig after they got in an argument, and Ludewig pointed an Airsoft pellet gun at him.

Investigators say Ludewig had been drinking and that the pellet gun looked like a real gun. The DA's office ruled that Ruppel was acting in self defense.

District Attorney for the 17th Judicial District Dave Young said investigators would have to prove Ruppel's actions were not in self-defense.

"When we file charges in criminal cases our burden of proof is beyond a reasonable doubt, so we don't just look at a case and say is there a probable cause for instance, is it more likely than not this person committed a crime," Young said.

"In Colorado, you're able to defend yourself with lethal force if you feel like your life might be in danger or the chances of you being severely injured are pretty high," Young added. "If you're going to pull out a pellet gun, be careful what you're doing."
