Argument between neighbors turns into death investigation

One woman is dead after the incident at Westview at Lincoln Station apartments in unincorporated Douglas County.

DOUGLAS COUNTY, Colo. — Douglas County Sheriff’s Office deputies are investigating a death after a disturbance Friday evening at Westview at Lincoln Station apartments.

Deputies responded about 4 p.m. to the report of a disturbance between two neighbors at the apartments at 10181 Park Meadows Drive, in unincorporated Douglas County, the sheriff's office said in a news release.

On scene, deputies found several people in the hallway as well as one female, Kelly Kiess, 24, on the ground with a gunshot wound to the face.

Andy Bernadeau, 22, was crying and yelling, "he shot her," "he didn't give a warning shot," and "he needs to go to jail," an arrest affidavit states. 

Deputies performed CPR on Kiess and she was pronounced deceased by medical personnel, the affidavit says. A 9mm handgun was found in the front pocket of her sweatshirt.

The affidavit says Bernadeau and Kiess were living together in one apartment, and Justin Chaney and Jamie Anderson, both 45, were living in another apartment in the same building.

Bernadeau told deputies he had just moved into the building and was locked out because he didn't have his proximity card. He said he followed Chaney into the building and was confronted by him and then an argument ensued, the affidavit says. 

Bernadeau in the affidavit said he slapped Chaney, knocking his glasses off. Chaney pulled a gun out and pointed it at Bernadeau ordering him not to move until police arrived. 

Bernadeau said at some point his girlfriend, Kiess, walked out of their apartment and began arguing with Anderson who was also in the hallway, the affidavit says. Kiess went back into the apartment and returned with a gun, pointing it at Chaney. Chaney then shot Kiess in the face, pointed the gun back at Bernadeau and ordered him to the ground. 

Chaney told deputies he was in fear for his life and Anderson's life, the affidavit says. 

The Douglas Couty Coroner's Office said Keiss had defects consistent with gunshot wounds in the front and back of the neck.

Bernadeau was booked in on charges of third-degree assault and has since bonded out.

Chaney was booked on a second-degree murder charge, officials said. His bond is currently set at $50,000.

Kiess' official cause and manner of death are pending further investigation.
