Judge grants motion to dismiss charge against Broncos WR Jerry Jeudy

As a result, the case against Jeudy is now closed and instead of his court hearing Tuesday he participated in the Broncos' OTA practice.

DENVER — An Arapahoe County Judge on Tuesday granted a prosecution motion to dismiss a charge against Denver Broncos wide receiver Jerry Jeudy.

The motion was filed Tuesday morning ahead of a hearing set for later in the afternoon.

In filing the motion to dismiss, District Attorney John Kellner stated: "The People believe probable cause existed for the arrest of the Defendant, and that law enforcement’s decision to arrest the Defendant was legally correct. However, in deciding whether to pursue a case the People are bound by the higher ethical standard of reasonable probability of success at trial and the legal standard of proof beyond a reasonable doubt."

In granting the motion, Judge Chantell Contiguglia also vacated the hearing and closed the case. A mandatory protection associated with the case was also vacated.

Jeudy was arrested on May 12 on suspicion of a misdemeanor charge of second-degree criminal tampering, with a domestic violence enhancer. 

Arapahoe County Sheriff's Office deputies were dispatched around 10:15 a.m. on May 12 after a woman called 911 for a "keep the peace " call, said Sheriff Tyler Brown.

Jeudy was taken into custody without incident between 11:30 a.m. and 12:30 p.m. that day and was cooperative with deputies, Brown said.

Brown said the woman reported Jeudy locked her wallet, a car seat, and their child's medical papers in his car and would not give her access. She told deputies she was trying to leave the home and wanted her property back, which he would not give her access to, according to Brown.

Jeudy was taken into custody and spent the night in jail. In court the next day, the victim said she did not consider Jeudy a threat and reported there was no physical contact. She said she wanted the charges dismissed and only called the police to have the situation monitored.

"Sometimes bad things happen to good people,'' Jeudy's attorney Harvey Steinberg said as he addressed the media outside Judge Chantel E. Contiguglia's courtroom after the hearing on May 13. "That's what this case is. I don't think he should have been arrested. I don't think he should have been incarcerated.''

In the motion to dismiss, the DA's office stated: "Based on conversations with the named victim (name withheld) that occurred subsequent to the Defendant’s arrest, the victim has expressed that she did not feel annoyed, inconvenienced, threatened or intimidated in any way by the Defendant. Thus, the People believe it would be very difficult to prove a necessary element of the crime beyond a reasonable doubt.

"Further, the victim indicates she wants the case dismissed and will not cooperate in its prosecution. Also, the victim has moved out of state and does not intend to return.

"Given all of the facts now known to the District Attorney and the victim’s position, the People believe dismissal is appropriate."

Jeudy remains subject to possible NFL discipline under the league's personal conduct policy. The league had been monitoring the Jeudy case. However, without any sort of guilty plea and given the non-violent circumstances with the case -- and with the case dismissed -- it would be a surprise based on recent NFL history with such matters if Jeudy received a suspension. 

With the hearing vacated, Jeudy was able to participate in the Broncos' OTA practice Tuesday.

“We have been right there by his side through this whole thing,'' said Broncos head coach Nathaniel Hackett after practice Tuesday. "I’m glad that everything has been resolved and it’s time to move forward.”

The Broncos' first-round draft pick, No. 15 overall, in 2020, Jeudy has a combined 90 receptions for 1,323 yards and 3 touchdowns through his first two seasons with the Broncos.
