ELBERT COUNTY, Colo. — A man is accused of fatally shooting his fiance's ex-boyfriend during a child custody exchange Sunday afternoon, the Elbert County Sheriff's Office said.

The sheriff's office said it happened just before 3 p.m. Sunday at a gas station on County Road 166 in unincorporated Elbert County. Someone called 911 and said the two men were fighting with each other, deputies said. One of the men pulled out a gun and shot the other, the sheriff's office said.

The sheriff's office said the victim, a 36-year-old man from Parker, was at the scene to conduct a child custody exchange with his ex-girlfriend. The victim and the ex-girlfriend's fiance got into a fight, and the fiance shot the victim, the sheriff's office said.

The suspect, 26-year-old Jeffrey Church of Colorado Springs, is being held on first-degree murder charges, the sheriff's office said. His next court appearance is set for Feb. 20.
