Autopsy report released after death of Kacey Fine Furniture president

DENVER – The attorney for the family of a well-known business woman is disputing the results of an autopsy report that was released Thursday.

The report, released by the Denver Office of the Medical Examiner, says Leslie Fishbein died of hypoxic encephalopathy, or lack of oxygen to the brain. Fishbein died at Presbyterian/St. Luke's Medical Center on March 19.

She had been in the hospital for nearly two weeks after receiving injections meant to treat an earlier horseback-riding injury.

The report says the lack of oxygen to the brain came after Fishbein's heart stopped beating, known as cardiopulmonary arrest.

The autopsy report goes on to explain that the heart failure came after pain trigger point injections in her back. Doctors were injecting bupivacaine to treat the chronic pain condition she suffered from.

The Chief Medical Examiner, Amy Martin, says there was no overdose of medication in her system and that there is no evidence that Fishbein had an allergic reaction to the medication.

Martin went on to say Fishbein had a low level of potassium in her system which may have contributed to the cardiopulmonary arrest.

Martin said in her report that Fishbein#39;s death was an accident, but an attorney hired by Sam Fishbein, Jim Leventhal, is disputing that claim.

Leventhal released a statement on Thursday that said: quot;It is premature to conclude that this is an accident and that the physician is not responsible. There are serious questions whether the procedure was performed properly, whether the doctor responded appropriately and whether he had the appropriate equipment. Until those questions are answered, it is premature to consider no one is at fault.quot;

Fishbein#39;s death was a sudden and unexpected end for a pioneer in Denver business.

Fishbein was president of the Jack Barton Co., which is the parent company of Kacey Fine Furniture. The firm was founded in the 1950s by her parents, Jack and Shirley Barton.

Fishbein joined the business in 1976 after graduating from the University of Colorado and never looked back. Her husband, Sam Fishbein, is CEO of Kacey's Fine Furniture.

Fishbein's death has been ruled an accident. She was 55.
