Denver mother acquitted in death of 9-month-old daughter

DENVER — A Denver jury on Tuesday found a mother not guilty in connection with the 2020 death of her 9-month-old daughter. 

After a day and a half of deliberation, the jury acquitted Jolene Beyer-LaCrue of child abuse - knowingly or recklessly causing death. 

Beyer-LaCrue's daughter, Gianna Rosales, was nine months old when she died of blunt force injuries in August 2020. Beyer-LaCrue and her boyfriend, Cain Gallardo, were both arrested in May 2021. 

Gallardo was found guilty in October 2023 of one count of child abuse - knowingly or recklessly causing death. He was sentenced in December to 40 years in prison.

"This was a sad and tragic case that never should have been filed against Ms. Beyer Lacrue," Beyer-LaCrue's attorney, Brackley Law Office PLCC, said in a news release. "We are thankful that the jury saw this case for what it is - Ms. Beyer Lacrue is a mother who lost her daughter in terribly sad and tragic circumstances due to likely abuse by Mr. Gallardo."

"Ms. Beyer Lacrue will grieve the loss of Gianna Rosales for the rest of her life," the release said.
